Иммиграционная служба Канады (IRCC) официально объявила о введении значительных изменений в правила предоставления открытых разрешений на работу (Open Work Permit, OWP) для супругов и гражданских партнеров иностранных студентов и работников, находящихся в Канаде. Новые меры вступают в силу с 21 января 2025 года и являются частью общей политики правительства Канады по регулированию рынка труда, ужесточению контроля за иммиграционными программами и приведению временной миграции в соответствие с экономическими приоритетами страны.
В соответствии с новыми условиями, право на получение открытого разрешения на работу для членов семей существенно ограничивается и предоставляется лишь определенным категориям в зависимости от уровня образования или сферы занятости основного заявителя.
Новые правила получения OWP для членов семей иностранных студентов
Согласно обновленным требованиям, с указанной даты право на получение открытого разрешения на работу для супругов или гражданских партнеров иностранных студентов предоставляется только в следующих случаях:
- основной заявитель обучается по программе магистратуры продолжительностью не менее 16 месяцев;
- основной заявитель обучается по программе PhD (доктор философии);
- основной заявитель проходит обучение по утвержденной профессиональной или специализированной программе, перечень которых будет официально опубликован дополнительно.
Таким образом, сопровождающие члены семей студентов, зачисленных на более короткие магистерские программы или программы более низкого уровня, больше не смогут рассчитывать на автоматическое получение разрешения на работу, как это было ранее.
Ограничения для членов семей иностранных работников
Аналогичные ограничения вводятся и для семей иностранных работников. Супруги или партнеры смогут претендовать на OWP только при условии, что основной заявитель официально трудоустроен в одном из следующих приоритетных секторов:
- естественные и прикладные науки;
- строительство и строительные специальности;
- здравоохранение и медицинская сфера;
- добыча и переработка природных ресурсов;
- образование и педагогическая деятельность;
- профессиональный спорт;
- вооруженные силы и смежные оборонные отрасли.
Если основной работник занят в других отраслях, не отнесенных к списку приоритетных, сопровождающие члены семьи не смогут подать заявку на получение открытого разрешения на работу.
Практические последствия для заявителей
Введение указанных ограничений существенно влияет на планы иностранцев, намеренных учиться или работать в Канаде совместно с членами семьи. Заявителям необходимо учитывать следующие аспекты:
- право сопровождающих членов семьи на трудоустройство больше не является автоматическим;
- необходимо заранее проверять, соответствует ли выбранная учебная программа или вид занятости основного заявителя обновленным требованиям;
- изменения могут повлиять на финансовое положение и социальную адаптацию семьи во время пребывания в Канаде;
- лица, уже находящиеся в Канаде в статусе членов семей студентов или работников, при продлении OWP также будут подчиняться новым ограничениям.
Заключение
С 21 января 2025 года право получения открытых разрешений на работу для членов семей иностранных студентов и работников в Канаде будет существенно ограничено. Эти изменения являются частью политики оптимизации трудового рынка и повышения эффективности контроля за временной миграцией.
IRCC настоятельно рекомендует:
- внимательно отслеживать официальные обновления о перечне утвержденных программ и профессий;
- консультироваться с лицензированными иммиграционными специалистами перед принятием решений о планировании обучения или работы в Канаде;
- своевременно корректировать личные и семейные иммиграционные стратегии с учетом новых нормативных требований.
Заблаговременное ознакомление с новыми правилами позволит избежать юридических сложностей и обеспечить эффективное планирование проживания, работы и интеграции семьи в Канаде.
